UAL to require all employees to get vaccinated

I am ok with the private sector requiring vaccines as long as its not a government mandate or backdoor policy. No one is forced to work at United. However at the company I run, I want the option to choose not to force it on my employees. My company, my choice.

I got the flu shot once, and I never have been so sick in my life due to severe reactions of the vaccine. I also had Covid-19 and I really had no symptoms other than being tired for a day or two. Based on this, my doctor recommended I do NOT get the COVID Vaccine. Does United have a policy to allow medical exemptions to those that get severe reactions to vaccines?

How do you know you’ll have a reaction for the Covid mRNA shot, based on your reaction to an egg-based flu shot?
 
Well, aren't you just the little totalitarian statist? First it's "get the jab or lose your job." Then it's "get the jab or go to jail!" What is lawful about forcing someone to get a medical treatment? Shall we have forced sterilization next?

You really don't have to bend over that far backwards, my dude, just ask him why he's for vaccine mandates but against mask mandates. Or maybe that's already been asked, I don't know, I try to ignore The Todd as much as I can. Inconsistent logic five!

For the record I'm in favor of both, though, just so you don't think I'm on your side or anything. You're both a junk drawer full of expired coupons in my book.

Exemptions are considered under the ADA and Title VII of the EEO. The common one will be the "sincerely held religious belief" language of Title VII. Pilots seeking an exemption due to medical reasons under the ADA could be putting their FAA medical at risk if the reason for the exemption was not disclosed as a health issue on their last medical application. This has (too the best of my knowledge) not been tested yet, but several people with way more knowledge than myself have stated it could be an issue.

The anti vax stance is its under EUA, not regular approval.

I don't disagree, but depending on how hard assed a company wants to be, the test for a sincerely held religious belief (as long as it is applied equally) can be very narrow. Vanderbilt University's law school keeps a list of all recognized religions and their stance on vaccinations. The list of ones that don't support vaccinations is pretty small and obscure.

The following denominations do have a theological objection to vaccination:

  • Dutch Reformed Congregations - This denomination has a tradition of declining immunizations. Some members decline vaccination on the basis that it interferes with divine providence. However, others within the faith accept immunization as a gift from God to be used with gratitude.
  • Faith healing denominations including:
  • Faith Tabernacle
  • Church of the First Born
  • Faith Assembly
  • End Time Ministrie
  • Church of Christ, Scientist - One of the basic teachings of this denomination is that disease can be cured or prevented by focused prayer and members will often request exemptions when available. However, there are not strict rules against vaccination and members can receive required vaccinations.
 
But you had the choice not to enlist. A current service member doesn't have that choice.

It's one thing to require vaccination as a condition of enlistment. It's another to mandate to someone who doesn't have a choice.

I wonder how well it would work if someone claimed to have founded a new religion that prohibits vaccination.

I don't know of any case law surrounding a brand new religion being created to provide grounding for a Title VII exemption request. The only thing I've seen is a 2016 decision that deemed The Church of the Flying Spaghetti Monster was not a legitimate religion when a prisoner Nebraska (or maybe it was Iowa... can't remember) requested special accommodations due to his religion. He wanted things like beer on Fridays, and to be able to wear a pirate costume.
