Cheating on FAA written exam

hey so I was accused of cheating during the FAA knowledge exam. The proctor allegedly saw me putting my phone in between the book and having it out during the test. I had the provided calculator in the book the whole time and did not use my cellphone at any point of the test. I also asked prior to my test if I need to leave my phone out and she said it's not needed as long as it's turned off and put away. They have camera surveillance which I told them to look at and was informed they do not record.. I was asked to stand up during the exam and had the book checked and they saw that it was not my phone but the calculator. But still made a report to the local FAA branch. I'm awaiting the mail from the FAA and I'm just wondering how I can prove my innocence and fight this case ? Am I given an option to appeal? How or what will I have to do? Any help would be appreciated as I am under great deal of stress

Out of curiosity was the report made after the proctor had found that it was a calculator or before?

Who was 'they' that only saw the calculator?
 
Wow I thought phones had to be left out in the waiting area while you take the tests, along with having a working surveillance system. Unless there is more to the story is sounds like the proctor was having a bad day.
 
You can't prove your innocence in this case. It's going to be your word against theirs. I'd check into the rules about recording the exam.

You might be hosed. And if the FAA makes you retake it, and you fail it...
 
Was it is a Laser Grade or CATS testing center?

What are the rules for phones in the testing site?

What is the policy for the camera?

The testing center may have some explaining to do also.
 
Something from page 4-7 of the above document:

b. Cheating. If an applicant appears to be cheating, the unit member must immediately
discontinue the test and escort the applicant from the area to avoid disturbing others who may be
taking tests. The unit member must collect the applicant’s authorization, all test materials,
including supplement book(s), and advise the applicant that further testing may continue only
after the FAA completes an investigation.
(1) The unit member must immediately notify the ODA administrator and the
jurisdictional FSDO of the alleged cheating incident. The unit member must retain any evidence
related to the cheating incident in a secured area until receipt of further instructions.


From what you said, it sounds as if they didn't keep any evidence (if there was any to begin with). How will the accusation be proven?

(Them) He had a phone!
(You) No, it was the calculator provided for the test.
(FAA) Let's see the retained evidence.

Every proctor I've been to hasn't allowed me to take my phone into the testing area....pretty much always wanted my pockets emptied. I have no idea why they would allow it or why anyone would do it.

This whole situation and testing location just sounds like all sorts of trouble. Hope that it gets cleared somehow

This has been my experience for the all the written exams I've taken.
