I think the TWU and Danny Pursuit did themselves a great disservice by going after the 542 leadership. If Danny wants the Local 545 to be the dominant local, why do everything to drive AA dispatch into joining the NAAP? You dont make your future largest group of dispatchers happy by removing its union leadership without giving it a fair chance to defend itself.

The NAAP offers hope for us in AA dispatch that after 15 years of giving concessions to management under TWU stewardship, we have a chance to move forward and negotiate the contract that we deserve. The TWU International was stalling joint contract negotiations thereby preventing us from moving forward to negotiate a joint contract.

Everyone in AA dispatch wants to do this merger the right way. We do not exactly have a good track record with past mergers. We want to see date of hire seniority integration with US Airways dispatch. We also want to find a fair way to resolve the scheduling differences.

You should have NO QUESTION NOW about Danny Pursuit's character and integrity. His participation in the hearing makes his agenda crystal clear. If you are a 542 member, you can be sure he DOES NOT have your best interests in mind.

On August 12th, 2014 Executive Board Members Dave Noble, Mark Turbish and Dan Persuit attended the TWU International hearing for charges against the Executive Board of Local 542. The hearing started at 10AM and continued until 11PM. This was phase one of hearings of two hearings. The second hearing was for similar charges against Local 541 on August 13th.

Despite the long day, information obtained as observers and witnesses was invaluable to us as Local 545 members. The testimony provided by witnesses’ Garry Drummond (ATD Director), Dave Virella (TWU AA System Coordinator), John O’Donnell (TWU International Accountant) and Gary Shults (TWU International Rep) painted a clear picture of the position and direction. As officers of the International, we take an oath to uphold the Constitution and abide by laws set forth by the Department of Labor. There were 59 Documents entered into evidence, many of which were directly correlated to both.

Local 545 testified about the NAAP raid, the lack of solidarity and the NMB filing.

Also in testimony, it was revealed that over 300 of the gift cards are not accounted for. There was not any confirmation that any of the Section Chairs or members received cards. A retainer fund for an Attorney of $50.000 was paid within a 30 day period prior to the Boards resignation. The Presidents phone and computer were wiped clean prior to return to the International. There were checks sent to Section Chairs for retirement and gifts after being instructed by the International not to disperse. This was done after hours followed by an email that instructed the Section Chairs to spend the money quickly before the International freezes the accounts. The entire transcript and evidence will be provided at a later time.

There may be some that are unhappy with the TWU International and its processes and practices. We can tell you it was impressive to see the seriousness and professionalism they took to uphold the Constitution, Labor Law and its members. It was not lost in the hearing that the Execute Board of 542 by resigning walked out on the 5 other Sections of the Local. Over 400 Members or two thirds of Local 542, were abandoned by the very people they trusted and elected. Who is there to protect these members? We can tell you that because you are part of an International Union and not an independent organization these Members have a voice and representation.

We are tentatively planning a GMM on September 3 at a time and place TBD. We are coordinating with members of the International Staff to attend. As always, thanks again for your patience and diligence as Local 545 Members.

The international suspended 542 with no investigation. The international now represents the rest of the members and the AA members until the elections. 542 e-board had the balls to give the international the finger and move on.

Danny, go home and tell your kids about justice and democracy. Then tell them how you participated on a hearing where they didn't allow the accused to defend themselves.

Come on FlightController. So are you claiming that plowman gave him more then he needed? And that there was a list of who not to give it too?

If that is the case, why am I hearing the the lead PAFCA guy took his?
 
I also checked out the PAFCA twitter and saw the "thanks for the 500". So we know your twitter guy got it. So we are clear, I'm not calling you a lair, I just don't believe what you are saying.
 
Not what I said... There were several dispatchers who moved to sector manager / Duty Manager position from the CRJ side... These were told they were not eligible since they moved into a "management" position and these positions were not covered by TWU... They have been paying dues since TWU came on property but wanted to further their careers... Hence the not getting of gift cards.
 
Ok. Then my bad. My response shouldn't have been so terse.

But so we are clear, every card given to your section chair was distributed. You just believe some others should have gotten one. Is that right? Because TWU international is claiming there are 300 cards missing. Sounds like Expressjet got theirs. I can tell you AA got theirs. It's just slanderous lies that 545 is just perpetuating.


It's time for everyone to get out it the TWU. Pafca and NAAP should take em all.
 
I was actually reading the TWU constitution today, specifically the sections identified in the charges against the 542 EB. This one jumped out at me.

"The funds or property of a Local Union cannot be

divided gratuitously among the members, but shall

remain intact for the use of the Local Union for its

legitimate purposes
."

To me, buying 600 American Express gift cards at a total cost of over half the locals treasury qualifies as dividing funds gratuitously, regardless of what the purpose is. Maybe it was intended to help improve communications. But the local also to my knowledge put no restriction on how that money could be spent so there was no guarantee that the members would spend it for that purpose. Maybe the bylaw itself is flawed, but it is still there.

Then later in the same document, I noticed the following paragraph which has nothing to do with the charges, but to me it shows that JP and crew did have a chance to defend themselves, but for whatever reason didnt take it.

"Within five days of such suspension, the suspended

officer shall be given a written statement of the

reasons for his/her suspension, and within fifteen (15)

days thereafter, he/she shall be given the opportunity

to appear and explain his/her conduct to such Board

or Council. He/she shall have the right to call any

member of the Local Union as a witness and shall

have the right to cross-examine any witness or any

member of the Local Union or of the International

Executive Council who speaks against him/her."


A Letter on this that I saw posted on another forum even backed up this claim. Apparently. because the board resigned, the hearing then became solely a trustee hearing since the officers no longer held office so there was no need to have the hearing cover the suspension of officers. It is my understanding that nothing in the letter prohibited JP and others from showing up and giving testimony on the issue of trusteeship. And JP has to know the above bylaw was in place as he has served on the TWU executive council in the past. Yet he didn't challenge this with TWU and instead went to you guys? It doesn't make sense to me. Does anyone know if the testimony given at the hearing was under oath?

Basically JP and company won't be convicted of anything because there is no longer any reason to remove them from office as they resigned. The issue becomes is the DOL going to get involved down the road?

I am also going to close with this. I have NOT had any conversations with Danny or anyone on the 545 EB about this hearing since the hearing took place. My above post is based on my own research of the TWU constitution as well as other things posted on the forums. I hold no loyalty at all to anyone except the combined workgroup of AA/US, who I want the best possible result for out of this merger.

The former board as well as all the members of AA wants what you want. It's just a matter of how we all get there. We have all put the TWU in the rear view mirror and moving on.

Everyone has their opinion on JP and what has happened and that's cool. Maybe the dol comes in, maybe they don't. They will defend themselves and move on from that.

So with that said, I'm done with this thread. I have had enough of the haters, the liars and the legal experts. I wish us all good luck in our futures, no matter which employer or union.

When is PAFCA going to have enough cards at Expressjet? It looks like PAFCA is going to get the CAL dispatchers also now that the UAL/CAL deal is done. TWU mucked that up by taking out the 542 board. The CAL dispatchers want to bail because all the. BS

PAFCA has filed for representation for ExpressJet with the NMB, AND, has an investigator assigned by the NMB as of today August 18.

Agreed. I encourage any 545 members to reach out to us at AA. Any questions, just ask! We want the best for both groups, get rid of the TWU, put the past behind us and move forward working together as one group!
 
I wish all you AA and US dispatchers the best of luck with this mess right now. The fate of our choice has been determined by this fiasco. I say this though as somebody who is just now finally getting a JCBA, do whats best for the groups as a whole, EQUALLY. Pick the group that best represents you BOTH groups, and if that calls for kicking out the TWU, then so be it.

We are all dispatchers, and nobody's lives should be affected because a union leadership pissing contest. I wish you guys all the best. Mergers are never fun. Still we are trying to figure out our own mess as well.
