interesting emergency authority reg

on the MMEL for the 737 it says


So im guessing a CA could NOT use the MEL notes to deny the seat or can they? It seems it says the fed will determine if the seat is acceptable but what about a LCA? Are they considered "other persons" or are they considered to be a fed in the MEL?
Not sure. I'm just the FO staring out the window wondering what I'm going to get for lunch.

Just wondering if anyone has ever used the regs in their favor to that extent. I mean they regs say you CAN do it but it DOESNT mean you should. Line checks are a part of everyday flying so why would you try to get out of it if its gonna happen? Might as well get it over with and roll the clock back on your currency.
 
I get that but WHY on earth other than a sincere safety concern would a CA deny the seat to a fed or LCA? By this I dont mean kicking them out mid flight if they are distracting but I mean denying them BEFORE the flight commences.
Because they are looking for a problem. Other than that I don't have a reason, let alone a good one.
 
I've had 3 line checks in the past 2 weeks. I think they're trying to get rid of me.

That seems excessive. I get wanting to make sure your a safe competent pilot who follows all SOPs but if you already got your required line checks then can you inquire if its a checking event or just hitching a ride.

If you can't understand why someone would use that authority during an emergency you shouldn't be a pilot or a dispatcher. Airliners.net is better suited for you it seems.
 
You would use that authority during an emergency if you need to concentrate on the problem and cannot have any unnecessary distractions such as jumpseaters.
 
This just doesn't make any kind of sense to me.
The using an AP to avoid a midair i got from this video from AA called AAMP in the 90s
the audio stinks but you can kinda hear the reference. If the time doesnt work just go to 16 minutes in.
