A little background info here - I signed up for an online IR ground school course called AviatorAcademy (aviatoracademy.com). For a fee of $69, I was promised an instrument rating ground course, completely online, with an instructor sign off on satisfactory completion. Well, I got through 4 of 12 sections of the course just fine, but could not move onto section 5 because my instructor had not graded the necessary assignments for me to proceed. After a month of not being able to proceed through the course, I contacted the owner who said he'd take care of it. After two months, I sent a very polite, almost apologetic email asking for a refund since I was losing the knowledge I had obtained up to that point. No response. Two weeks later, I sent another email - same polite tone - no response. Finally, three months after I was unable to proceed through the course, I sent a professional, but firm email...


Mr. Wright,

This is my final request for a refund of the $69 I paid for the Instrument Rating Course offered through your web site. As I have detailed in previous emails, I was unable to proceed past section four of your course, and it has been nearly three months since any of my assignments have been graded. As such, I have been forced to pursue my instrument ground training elsewhere.

It would be in your best financial interest to respond to this email promptly. I have already obtained the necessary information to seek financial damages for paid services not provided from the Harris County Justice of the Peace. I fully intend to bring a case against you to reclaim these damages, as well as all costs associated with the case. As such, it would be financially wise of you to refund the $69.00 I paid for this course through eBay purchase and spare your self greater expense. I have also contacted several individuals who have expressed interest in writing letters of evidence on my behalf - these individuals have had negative business experiences with you, including not being paid for services rendered.

I will wait 7 days from today (26 June, 2007) before taking legal steps. If I don't hear from you after this time, expect to be served.

Your approach of rattling the legal sword may cause many to tremble, squat, and evacuate their bowel but it doesnt work on me. In fact you have just turned yourself into dog#$%& in my eyes and erased any desire I had to appease you. The fact is if people arent trying to sue you then you just havent attained success yet.

First of all you dont tell me whats in "my best financial interest" Who the $&%# do you think you are you arrogant little $&#!sucker? If you think Im going to $&%! my pants because some little prick is threatening a small claims suit for $69 you are sadly mistaken. First of all, Harris County is NOT EVEN THE PROPER VENUE because the business is an incorporated entity. I am a corporate officer who happens to SEASONALLY reside in Harris County but that is NOT the location of the business and I am protected by the corporate veil. So go ahead and file in Harris County and I will have it dismissed on motion because Harris County does not have jurisdiction. Secondly, I dont know who these "people who didnt get paid" are... I know of ONE person who didnt get paid who went off like an idiot posting #### all over the place. He was a @#$% $2 an hour Fillipiono graphic artist who tried to bill $300+ for MISPELLED LOGOS which I obviously cannot use. "Aeronoticul" "Avaiter" etc... So since you like to make legal threats - BE GD SURE you can back up any allegations you may make or you wont be able to afford to fly. You may have heard of the term "counterclaim"?

Be aware that your threats of legal action are laughable. I am not afraid of the @#$% (rhymes with"bunt") I wasted 3-1/2 years of my life with trying to get me to pay child support on kids that arent even mine so I sure as hell am not afraid of you and your $69 civil matter. I dont know if you are a lawyer, or if you just think you, are but rest assured either way it doesnt impress me. Lawyers are scumbags, little $%@*& (gay slur) who got their @$#&% kicked all through school, and Shakespeare was right about them... I owe you $19 Guthrie Beardmore owes you $50. Stop being an @#$%& with the legal threats and Ill send ya a whole $20. Consider the difference a tip counselor! After all, if your practice is so booming that you have time to @#$% around with a $69 civil matter you need it more than I do.

PS - On the outside possibility that the Texas courts, which are famously conservative in their awards, did give you some grand judgement complete with huge "damages" on a $69 civil matter - HOW LONG DO YOU THINK IT WOULD TAKE ME TO DISSOLVE THE CORPORATION???? KNOW WHAT WOULD BECOME OF YOUR JUDGEMENT THEN???? HMMMM COME TO THINK ABOUT IT MY GIRLFRIEND COULD MAIL IN THE NEW CORPORATE PAPERS ON THE SAME TRIP TO THE POST OFFICE WHEN I MAIL THE DISSOLUTION PAPERS! I know you bought it off eBay, but with a website and a 'business' maybe you could forward that to the Better Business Bureau? At least do everything you can to get this jack's name out there as being someone to never do business with!

Yeah, I'm going to try to do what I can. The funny thing is, if he had told me that I needed to request the refund from the instructor, I would have done so. This was the first time he contacted me about it, though. Karma will get this guy, though.
 
Well bro, if it sounds too good to be true....it usually is. For $69, I would just write it off as an internet learning experience. The best outcome that I realistically would expect is to let others know about this donkey (which you have done here), so that people in the know will know to stay away.

Sorry about your experience with this guy and the $69. Go out and buy a respectable IR ground course and put all of this energy into learning the info for the ground and oral.

BTW - I really liked your last avator. The Summer's Eve bottle and package was a classic. Got my vote for top 10 of all time. Forced to change it?

Just to file in small claims court will cost you $20-30.

But you might do it to make him spend hundreds of bucks just getting an attorney to deal with it.

Also, did you pay with a credit card? If so, dispute the charge with your credit card company. Tell them the product was never delivered.

Because this guy was a prick, I'd go out of my way to find little things to piss him off.

I don't think he is - I did an FAA records search and the only Kevin M. Wright on there has a student ticket.
 
Methinks showing that reply at court will probably not endear him to the judge. I'm just amazed he could be stupid enough to email a letter like that.

Definitely take him to court and contact the attorney general as a possible fraud conviction will make it harder for him to start another business. This guy is ripping people off and you'll be doing the world a favor by suing him.

I actually just filed a formal complaint, including a copy of his email, to the Texas State Attorney General's Office. I used to work for a U.S. Rep from Texas, so I'm going to send an email to one of his staffers to make sure it gets through.

I thought about that too - would be interesting to show a judge his email in small claims court.
