I would put LGA2.LGA in the route but lets say specifically you want to do the "Flushing Climb". what would you say to ATC and how would they respond back? (if required)

The DP out of LGA is given to you based on the flow for JFK and PHL. So you don't ask for anything. They will give you what they need out of you.

perfect that is what i needed to know. so do they let you know on the takeoff clearance or when you receive your IFR clearance?
