It’s the seniority system. If moves don’t work out, it’s not fair to the current pilots on the list who decided to stay.

I doubt AS would take anyone back. I’ve heard they keep track of that stuff and hold it against us if we go to the big 3. Plus we have to give a one month notice.

Well CA, OR, and WA are at-will states, so you don't have to give any notice. You can just literally walk off the job. Traditionally two weeks notice is just a courtesy to your employer, big surprise the eskimo does things differently. They require you to give one month notice to get paid out on vacation (should be criminal). If you give notice you should be able to rescind it up until your last day and keep your job, as your resignation hasn't taken effect yet.

I agree, but isn’t the CBA more encompassing than local CA laws? In any case I’m assuming that by Saturday one has probably already resigned for a Monday class.

Either way it’s a crappy situation.

You are conflating concepts here. While I feel for the people impacted, let’s ge facts straight.
All states but MO have an at-will doctrine. Either party can terminate the employment agreement at any time for any reason that is legal or no reason.

Employers in some states can requirenotice to pay out vacation time earned. In California they must pay it as it was earned. But, in most states in which the restriction applies, that also means the employer has to pay you two weeks in lieu of notice if they fire you or else you are eligible for unemployment compensation during those two we.

But none of this has anything to do with those who resign. An employer is under no obligation, outside of any CBA, to rehire and restore to a previous state of employment. If they do, that’s great. But they don’t have to.
If one gives notice, and the final day passes, they are no longer employed. It’s sad but it is a fact.

Yeah I totally agree, if you've resigned and are gone, that's kind cut and dry. The murky part Is if you give them the courtesy of notice and within that notice period, decide to rescind your resignation.
 
If you can take an LOA, do that. If you can take vacation, then go to class over vacation, do that. If you can start your next job before you quit your first, do that. If you can do anything to possibly prevent this from happening to you, do that.

Most majors ask for a copy of your resignation letter before training starts. Too many guys did this trick.
 
When I started at Virgin they asked for a letter from a CP or HR that confirmed not only that I had resigned but also given up any seniority rights at that employer.
 
I resigned an hour before class started. I was out on leave anyways. Had a family member with health stuff going on and couldn’t risk healthcare being cut off.
