All I'm asking for is less hyperbole an more scientific method and common sense. Patting down a 10 year old seems doofus in the macro sense, but realistically speaking does anyone think Al Quada hasn't thought of using a blond hair, blue-eyed eastern European as a contraband mule? Find the course of least suspicion and exploit the weakness.
The legislation is HR 6416, and is being called the American Travelers Dignity Act.
The language of the legislation is straightforward, and removes the immunity that the government currently enjoys when a federal actor (the TSA), working as an arm of the federal government, proceeds to enforce the new AIT and enhanced pat down policies. The language is as follows:
This is something that all of us should be standing behind, as it creates the best incentive that exists in this country to force charge; the removal of government immunity on this issue, paving the way for lawsuits against the government. This will allow individuals to sue the TSA and thus make it financially untenable for the TSA to continue these policies.
It's a simple, yet bold statement that needs to be made, and I hope every single one of you call your elected legislators and urge them to support this legislation.

Really not a relevant question in this debate. There are plenty of issues in the 4th, 9th and 10th amendments that will be worked out in the courts. Hopefully the new congress, muzzles or abolishes the TSA in their present form.Flying on a plane is a fundamental liberty?

But here's the trick.
Do NOT take this as a defense of the TSA.
But if Ruth's Chris requires that I wear a coat to eat in their restaurant, I can choose to dine at The Sizzler without the jacket requirement.
If I think the TSA is being unreasonable, as a passenger, I can avoid screening by riding the train.
Again, the public being "up in arms" and engaged can be a good thing, as long as they're armed with science, reason and reality.
A torch and bat wielding mob is awesome, but not when they're out chasing witches around Salem.
Its really gonna be great flying the day after some Jihadist attempts a boarding with a bomb up his bum.

There's a real simple, low tech solution to this entire problem.
Dogs.
Train zillions of dogs to sniff EVERYTHING that comes into an airport. Rampers, passengers, pilots, luggage, caro everyone and everything that comes into the secure area, every day.
Nobody is going to have a problem with this. Not only are the dogs doing an incredibly valuable public service by protecting our natural security, they're cute and furry. Cute and furry things have never done anything bad or harmful before (http://en.last-video.com/wp-content/uploads/2010/07/bear-attack.jpg), and I think the American public would accept this without question.

I am actually! I'm horribly allergic to dogs, so much so that I have problems breathing around dogs. I'm probably one of the worst examples of what a dog allergy can be.
That being said, I have no problems with being around dogs for short periods of time. Do I walk up to them and rub my eyes on their fur? Of course not, but I've got no problems with being around them for a while.
Some cultures wouldn't be so accepting of dogs but I'm okay with them. They are better than any machine.
