that part of their scope clause you are refering to is 70 seats or less, so it does not allow for any more aircraft from 51-76 above the 255 limit with 120 of those being 900's which they are already over.
ASA is in the process of fitting all of its CRJ-700s with 1st class seating(taking the forward lav out) which drops the seats from 70 to 66. Would this allow Delta to circumvent the 70-76 seat RJ scope clause aircraft limit?
