Dude I feel your pain, I worked as a charter flight broker and just wasnt cut out for it. So much stress and pressure to do whatever to make the sale so I gave my two weeks after working there for 5 months, with nothing lined up. Fortunately 3 weeks later I got a call for a flying job that I have now. First corporate gig, flying a jet, so all hope is not lost.
 
$600 and up in any calendar yr triggers a 1099 form. That dude is seriously on the hook. Under reporting, evasion...those are good places to start. I bet if he aint paying you, he aint reporting it. Call the EEOC but before you do, give this jerk one more chance to make it right. Don't mess with labor. You'll get your money if you go to bat for it. Deal or no deal, you'll get your money.

Now come here so you can be cuffed behind the ear for letting it go on this long.
 
First time I have logged on in a while since I have decided to go a different route. Just wanted to check in and see what is being discussed and how the general view of the industry is. In any case, I felt the need to chime in on this one.

I know who DPA worked for (company and individual) but I will let him provide that info. if he feels he needs to. The operation is a shaddy one, as DPA is not the only person to fall victom to this individual. There have been instructors in the past who never got paid because they were supposedly logging time by flying traffic (all that I know quit real fast after finding this out).

Also, I personally would question some of the aircraft as I had seen windows being held in with duck tape, doors attached with only one cotter pin (yep) and a host of other things.

Very, very shaddy deal and I would be looking to set a few things straight! But DPA, why did it take you so long to get fed up?

I am pretty laid back, however, there are four things you don't F with; my woman, my friends, my possessions and my ability to make a living!

I can't comment on things before my time, but they used to have a not so great A&P. The guys they currently have are pretty great though, I would trust my life any time I fly one of their aircraft. They're still finding things from the last guy I guess.

Not sure when the new guy was hired but this was in August of this year!:confused:

DPApilot I feel your pain. I've been in a similar situation for several months now, being paid constantly weeks late. Whenever the instructors complain, the owner tells us how he's got a stack of resumes on his desk and how they're willing to instruct for half of what he's currently paying us. The world is really messed up right now.:mad:

I've constantly been looking for work, even outside of aviation and can't find anything.

It's tough out there right now, good luck.
 
Start with a phone call to these guys on Monday...most states have employment security regulations, which work in conjunction with federal employer requirements. Get a written statement from your coworker(s) about your day to day responsibilities at your former place of employment.

Don't get mad...get even (legally speaking)

How much does this person owe you? If I were you, check into seeing how much it costs to file a claim in small claims court. The odds are very good that if you do, he will cough up some dough to get you to drop the lawsuit.

For him, the lawsuit would invite attention from the IRS. They do not like employers who do not pay payroll taxes. That will get him in a hell of a lot more trouble than paying you is worth, so if he's as shady as he seems to be, then he'll say, uh, here's some money, can you drop the suit?
