I'm wondering how long I would be patient about not getting paid, W-2 or not. I am thinking it would not be a couple of months. Maybe 2 days tops before I start getting really bitchy.
If it's a few hundred bucks he ows you, then I'd go talk to a labor board, and tell them he never gave you a W2 to fill out. Put the monkey on his back. If Max is in the same boat, saftey in numbers my friend. There has to be something you can do. I'd get together with Max and seek legal advice. Or atleast talk to a labor board in pair. Never been in that situation, but I know there has to be something you can do. Was he taking taxes out of your checks? Or was he paying you cash? Are there time cards or something of the like to prove you worked for the guy?
Max was paid. He filled out a W2, smart kid. He got me 2 years ago on the "it'll go right on your account, no taxes, since you're going to use it for flying". He fired me and the rehired me making a deal that I would finish this job and get paid. Well, I've been coming in since September, never finished thr job, but only because he's having me do everything but that. And max can vouch for it.
You are not in trouble most likely. I doubt you earned enough to even file a 1040. I am thinking your boss is in big trouble - no tax witholding, no payroll tax (read up on the nanny-gate controversies that always snag politicians - same thing with you) as well as the fact that you could turn him in and potentially get whistle-blower money (probably not, but possible).
