Getting IFR Clearance In the Air (ATC not happy)

It still isn't okay, but it is legal. Pilots should be able tell by the frequency congestion if we are going to have the time.
Begging your pardon, but you can't tell if a controller is busy by how loud the frequency is. I've had an approach controller and an enroute controller independently tell me that.
 
Well since I am a controller and a pilot ( previous commercial) I can tell you that you can. If it is hard for you to check in or get a word in edge wise, that is frequency congestion.
We welcome facility tours now. I encourage all that fly to come visit. It will give a different perspective.
