Gotta be a little careful about how you say that. I know you didn't mean it, but what you wrote could be construed as carte blanche to disregard all FARs during an emergency. What you are really allowed is to deviate from the FARs only as necessary to handle the emergency. I think I know what you were going for here, but again the wording is a little problematic.If you lose comms over the ocean, and don't have the range to make it clear across, your only option would be to ditch. I think that would qualify as a situation that would allow you to deviate from the FARs and you would be able to come across the ADIZ to land. Even if you are intercepted, as long as you cooperate and have a ligitimate lost comm, I really doubt the issue would be pressed.
I'd agree. I would do everything possible, including turning around or landing short, to avoid flight in an ADIZ without talking to the guys that control the trigger fingers.Now if you just happened to be on a flight plan that took you through DC and lost comms, I'd suggest going around that ADIZ, or if I was comming up from Mexico I'd land in Mexico and get the radio fixed there before trying to penetrate the ADIZ.
