I'm willing to bet there's more to the story and the passengers were actually inside the terminal who reported this. The aircraft apparently was on a ground stop to NYC so the crew decided to kill time. The mad passengers see the crew "goofing around" and decides the media needs to know.

I think the issue is that a flight attendant working the flight was not on board the aircraft when there were passengers on aircraft. I'm guessing the FAA frowns on not having the required component of flight attendants.

I'm pretty sure I read that the flight had yet to board.
