Cheating on an FAA knowledge test

Hi everyone,

There's this guy I know who was caught cheating on a knowledge test with his cell phone. FSDO caught up and put a ban on him for a year.

He wants to know if this means,
- he can give a checkride for his IR this year or has to wait?
- he is banned under part 61 can he take a ride under 141?

since he cannot get in touch with the ASI who handled his case.

also, are they obligated to interview him or something because he says they never did.....

61.37 will answer his questions:)

(1) Applying for any certificate, rating, or authorization issued under this chapter; and

(c) Any certificate or rating held by an applicant may be suspended or revoked if the Administrator finds that person has committed an act prohibited by paragraph (a) of this section.
 
Yes, already had gone through that one.....I guess he is lucky that his PPL/CPL isnt suspended though......thanks for your help!
 
Why on earth would you cheat on those test when you can just memorize the answers like most everyone else does?:)
 
If you need to cheat on one of those tests you shouldn't be flying in the first place.

The need of someone to cheat on an FAA written test shows that natural selection has been removed from the human race.:banghead:

If I remember, there are very specific things you can have and not have and cell phones or any type of computer with nonvolatile memory are strictly verboten. This should have briefed ad nauseam beforehand. Even if he wasn't "cheating", having a cellphone is a violation of the rules.
Your buddy should grow up, and take his suspension like an adult. Now if he didn't have a cellphone out, wasn't caught on tape and was totally innocent, there are administrative law judges for cased like that.
