It's often placed in contracts as a non-binding event. I deal with it in nearly every commerical contract I read.

Non-binding arbitration is usually only used in non-labor contracts where the expected outcome is a settlement. It's similar to a PEB under the RLA, where the PEB issues a non-binding recommendation that the parties take into consideration, but are not required to abide by.

Under the RLA, however, System Boards must have a final and binding method of resolving disputes. The entire purpose of the Act is to resolve disputes without labor disruptions. Therefore, non-binding arbitration doesn't work.
