Her attorneys served the airline with a legal complaint detailing the allegations in mid-February. The airline didn’t take any corrective action, and the captain still works at the airline, and she’s scared she’ll be forced to fly with him again some day

I’m not sure how it would be in their state and with union, but most non-union employers can terminate employees without being criminally prosecuted for a crime. There’s usually a clause about bringing negative attention to the company can be grounds for dismissal.

I'd guess he's still employed but not out flying. It's pretty normal for a CBA to have a provision to put somebody in administrative status during an investigation.
 
If the 5-0 doesn't find cause to prosecute, then I'd imagine it would be difficult for the airline to take further action. From a legal standpoint, I'd imagine the airline's best move is to put him on leave until an investigation is carried out by a law enforcement entity with jurisdiction.

There's video of them in the elevator that makes it sound like she wasn't consenting to anything.
 
Private sector employees aren't afforded due process in the manner you're implying. Here's an example.

Forced to resign, and likely had his career destroyed after a fellow student affairs employee accuses him of taking advantage of her. Not only did the police not find grounds to pursue anything, the organization they both represent (comprised of hyper-sensitive, critical theory higher ed types) found no reason to deny him further association with the group.

Based on the write-ups of I've read on it, they had drinks and she decided to sleep with him - felt angry about it the next day (*cough cough - Aziz - cough). My personal take - her social media history and writings suggested that she likely felt that she needed a #metoo story for people to take her rants about male culture of rape seriously. Just had to destroy one man to get there - and this guy happened to be in the way.

Alaska doesn't operate a police force - makes sense to let the law do its thing.

I never said that. I just said that it would be wise for Alaska to wait until law enforcement has an opportunity to investigate before taking any action, other than temporary suspension. If he ends up charged, then it makes the decision easy on the company. If not, then they can take it on internally.

You should at least acknowledge that you're not able to separate yourself from your emotional response to this story enough to advocate that both parties are given a fair opportunity to defend their actions/accusations.

Criminal and civil standards are different for finding fault. OJ Simpson was acquitted in his criminal trial, but still lost in a civil trial on the same issue.
