If that's the case Delta is doing a horrible job getting its story out.There were three travelers and two tickets. The unticketed child was put in the seat which there was a paying passenger which was not with the party.

Brian Schear said the family had initially purchased a ticket for their teenage son on the red-eye flight, but decided to send him home early so that their 2-year-old could have a seat on the plane. The couple was also traveling with a 1-year-old.
He said they let the ticket agent know about their situation at the gate, and that the agent accommodated the family to sit together.

A fifth member of the family took an earlier flight.
A delta employee told the father "This is a federal offense and then you and your wife will be in jail and your kids will be in foster care"
A delta employee told the family that children under 2 must ride in a lap.
If these things aren't true, then delta needs to put out a statement denying these things and demanding corrections, because that is what is being reported.
Here’s what it sounds like happened….
It’s a family of five – two parents, two babies, and a teenager. They originally booked four tickets for the flight in question for all five with the parents planning to lap hold the youngest. Parents decide they don’t want to lap hold a toddler for a five hour flight from OGG-LAX. So, they purchase another ticket for the teenager on a different flight and erroneously believe they can just shove the lap baby into the teenager’s seat no questions asked.
Boarding time comes, and since they haven’t changed the name on the ticket to reflect the baby instead of the teenager, teenager is shown as a no-show and the gate agent likely believes the baby is a lap baby while the parents think they’ve got this all squared away and they’ll just put lap baby in teenager’s seat. Teenager/lap baby’s seat is given away since teenager is a no-show and it devolved from there.
I don’t fault southernjets for the initial incident, but threatening to send the kids to fostercare was a bit extreme.
Supposedly, this was cleared up with the gate agent, according to Mr Schear, but I don't know if everything was clear with that or whether it was actually done, or whatnot. That's his claim.

I never said it was bad policy. I said it allows the government to modify a contract legally entered between a creditor and customer.

I can't believe some of you would be cool with missing a commute because some guy "paid for the seat!!!11" and didn't show up, but by that logic you're not getting the empty seat.
This is exactly what Brian was thinking "Hmmm, if I send Billy home on that other flight, I can assume I will keep the seat and have Maggie sit there so she doesnt have to sit on my lap. Hmmmm. Yes, I think this should work. I mean, I did pay for the seat on this airplane so I am kinda entitled to it. I sure hope the flight isn't full or this probably wont work"
I find it very hard to believe that Brian didnt know exactly what he was doing.
. Until the airlines stop apologizing for stuff that is clearly not their fault and rewarding the behavior, people will still continue to try and cheat the system. Employees need to stop playing into it and becoming part of the problem. The airlines need to back up employees and not throw them under the bus. There really isn't any customer service training that teaches frontline employees how to interact with customers in these type of situations.Also, looks like they are getting a full refund + "additional compensation"
Delta Air Lines issued the following statement today regarding Flight 2222 on April 23:
"We are sorry for the unfortunate experience our customers had with Delta, and we’ve reached out to them to refund their travel and provide additional compensation. Delta's goal is to always work with customers in an attempt to find solutions to their travel issues. That did not happen in this case and we apologize."
One more person pisses you off, and they're going to get a visit from Eric Wildung and his friends, who will offer them an east coast attitude adjustment.
