DHS claims pilots have no right to refuse search!

I just got"ambushed" by 12 guys from CBP(customs and Border Patrol) for a ramp check in Marathon FL. I never crossed the border,I was under IFR flight plan coming from KFXE. Can they do that? Under what law? Nothing happened, but was not a nice feeling, and just wondering under which part are they allowed to do that? I know "...authorized by the Administrator..." but in that case do they have to have a written authorization, or something of sorts???

No written authorization needed for a ramp check, which is just a funny name for a documents check.

And guys, this is straight out of Part 61.....the Bible of sorts for what you do and the standards of your Certificate you hold and exercise the privileges of.

14 CFR 61.3(l). It includes the TSA. Unless you're a Flight Engineer, then it doesn't include the TSA.

(l) Inspection of certificate. Each person who holds an airman certificate, medical certificate, authorization, or license required by this part must present it and their photo identification as described in paragraph (a)(2) of this section for inspection upon a request from:
(1) The Administrator;
(2) An authorized representative of the National Transportation Safety Board;
(3) Any Federal, State, or local law enforcement officer; or
(4) An authorized representative of the Transportation Security Administration.
 
And, knowing a DHS who I trust implicitly, I can't imagine MikeD being all penile-erectus about doing a search on a presumably law-abiding citizen.

I just don't see why everybody rushes to compliant to thugs with badges. I deal with these pricks way too often I guess. Between DOT, State Police, Border Patrol, Port Authority and DHS...I can barely get my job done and then I gotta answer questions like I'm a criminal?? Hell nah!! Not up in here!!! And especially not when I've not crossed a border.

For a document check, its clear in 14 CFR 61. Obviously any kind of search has requirements unless at a border. But you drive a truck, right? Aviation document check is the same thing as getting pulled over by Commercial Enforcement officer for a safety inspection or to inspect your vehicle logs; no level of suspicion needed to do either.
 
These TSA drones tossed our plane once in BOS when I was at Colgan. Then tried to leave it a mess. I got pissed about it while the Captain said it was OK. I doubt the FA thought it was OK because she had to reassemble the seats. Which I helped her with because I wanted to do her job and injure myself in the process. Right after riding the belt loader. :p

Was any reason given? Did you guys happen to file a complaint or inquiry to the company about it? Id be surprised the company would just play along if there was no probable cause for a search or the flight was made to be late or the plane put out of service.
 
Random search and I was a green FO so I dunno about the rest of that. The flight was not late or out of service. They came on and flipped seats and left.

Yes but not answer accusatory questions from DHS or Border Patrol when I'm 80 miles inside US land.

That's indeed weird, that no reason would even be given. Did the company even know it happened? I mean...its their plane being searched. And thats a fairly big deal......as we're not talking searching some simple handbag at the security checkpoint here.
