If this was Colgan there would be an outcry that they were unsafe.
What could've happened? Just like the Mesa -8 in PHX destroying the GPU. Just because you're pulling into the gate doesn't mean you don't have responsibility for the aircraft. Someone on the flight deck should have been paying attention.
If that wasn't the case you (as in flying pilots) wouldn't need marshelers.

That's a criminal law issue, which is a class we take in our second year. If there's a lawsuit over this, it'd be a civil case, where the issue would likely not be guilty or innocent, but instead liable or not liable.
