What can a NASA form do for you?

The form is a method for collecting data used to enhance safety. Unfortunately, many see it only as a "get out of jail free" card. It is to everyone's advantage to send in a report when a safety issue arises.

Many 121 operators have a similar self-disclosure program. Most likely the thought that the ASRS program had been halted originated with the halting on one particular carrier's self-disclosure program.

The form does provide protection from FAA sanctions (punishment) in many instances. Intentional violations and accidents are not covered by the program.

If the FAA proceeds with an enforcement, it cannot use the information from the ASRS report. It also cannot impose the sanction upon the airman. However, it does enter the enforcement in the airman's record the same as if the sanction had been imposed. The report also does not prevent the FAA from requiring the airman to undergo a 44709 reexamination.
