No. The only Part 135 carriers that have unions to do this are the fractionals. I believe most of the time they operate under 91k.

Us poor 135 peeps don't have any way to file a lawsuit that would make a dent.
 
I'm sure ALPA has already dumped tons on money into these new rules. Perhaps they hope the UPS pilots will succeed so they don't have to pay more?
 
ALPA still stands by one level of safety guys. That hasn't changed.

Even with the language "finished," don't think that the Association has stopped with the support for one level of safety throughout the industry, regardless of passenger vs. cargo.

I don't know of any fractional operators that operate under 91k FT/DT rules. Most 91k operators also hold 135 certificates. We do not, but there's a provision in 91k that allows unto operate under 135 FT/DT rules.

I don't either, I just mentioned them as they are the only ones that may have a chance at helping to bring change to the part 135 world. Part 135 Cargo? No chance at all.
 
I am happy to see a lawsuit that makes sense and will do some good in this sue happy society. Hopefully the court systems aren't so overloaded with other pointless cases that it takes them years to get to this.
 
Thus will be an interesting suit to follow. I wonder how the FAA can defend themselves.
As I see it they can't, the whole primmiss of these rules was based on the circadian rhythm and how start times affect our inner clocks. If that is really true you can't exclude a group of pilots that make up over a quarter of the 121 pilot group.
