Those who have taken ATP with expired written

I just took my ATP with a local DPE with an expired written with no issues. I am current 121 and the written expired while I was still with the carrier (still am).

IACRA took the results just fine although did have a prompt for the DPE just to tell him it was expired and he clicked yes or something along those lines and it processed fine and gave me my wet ink cert.

On one of the "other" forums a few have mentioned that they are pretty confident that KC will kick it back because I did not take the checkride in my current approved 121 training program.

I know a few on APC who were either current 121 or furloughed 121 who went out and did the exact same thing I did and I just wanted to get a consensus to see if any of you had any issues or if it all worked as planned and the plastic cert arrived as expected.

The application will go through and the plastic certificate will arive.

The question is if "furloughed" is the same as "Is employed as a flight crewmember by a certificate holder under part 121, 125, or 135 of this chapter at the time of the practical test" as used in 14 CFR 61.39(b)(1). If it isn't, a good case could be made that the certificate was obtained through falsification.

61.39(b)(1) also states that an applicant must have "satisfactorily accomplished that operators approved -
(i) Pilot in command aircraft qualification training program that is appropriate to the certificate and rating sought; and
(ii) Qualification training requirements appropriate to the certificate and rating sought"

Now that doesn't mean that you have to take the practical test with your carrier, but it would be weird if the above was not also your practical test.

I know it has always been a gray area and has been discussed quite a bit here. It appears to read that the applicant can use the expired written provided they are and currently were employed at a 121/135 carrier at the time the written expired AND completed that carriers PIC training.

Where the gray area seems to be is that I have read on here of quite a few people who fall under the expired written exemption and have gone to a part 61 location and taken the practical and had no further issues. My dpe had no problem with it and iacra accepted it with only a mention that the written was expired, it then processed the application fine.

What I am trying to find is people who have done the same thing and if they had any issues getting their permanent license from OK after the fact.

I did not expect it would be any issue until a few others have said be prepared for OK to kick the whole thing back, revert you to a comm and then have to re-take the written test again. Re-taking the written is not something I plan on a. paying for the study guide b. studying for and c. paying the new fee to re-take the written.

I did find this from CRJDriver back in 3/2009

I called up my local FSDO to confirm. The FSDO had to call Oklahoma City to confirm as well. It took about a week to get an answer and clarification, but they all assured me I was good to go.

My DPE knew how to handle this situation, as he had dealt with it before. We just did a paper 8710, because IACRA would just reject your written and say it is expired.
The only difference between him and I is that iacra does now accept the expired written, it only makes you acknowledge that it is expired. Where a new issue could occur is that they have no way of knowing that I am currently employed part 121 since you cant attach that to a E-8710 iacra.

I guess we will find out how it works in a few weeks.

I haven't done it, and I don't know anyone who has, so I'm sorry I can't offer any further insight. Just curious, did you complete your carrier's PIC training, and if so, why wasn't that also your practical test?

Yes, as quoted above, I did take my ATP ride with an expired written. Do a paper 8710 and it shouldn't be much of an issue.

That was the back up plan (I did the ride last week). IACRA took the written results just fine but as I mentioned it had a disclaimer where he verified the written was expired.

I am wondering if they leave it up to the DPE to determine whether or not it is an acceptable circumstance to use an expired written.

I was glad when I saw your post that your situation (exact same as mine minus the furlough) was cleared and confirmed ok by the guys in the big building in Oklahoma.
