Tense exchange between ATC and pilot at JFK

That's pretty crazy. Whoever was working the radio sounded like he had a mouthful of oatmeal declaring that emergency. I have this vision of the captain yelling at the first officer telling him to tell the controller they needed 31R or else they'd declare an emergency. He was about as decisive as a squirrel in the middle of the road until he finally hit his breaking point (with the controller, captain, or both?) with the whole "I told you three times already" comment.
 
I want to know the story behind this one. Something just doesn't add up.

Why was this guy so low on fuel?

What JFK the Alternate airport?

Did they pass their concerns onto approach about the runway in use? I am sure they had to have the weather by 100 miles out?
 
Good for them.

We've landed at TEB quite a few times with a 10 knot tailwind component. All because of "SOP" due to EWR. It's bull crap. And that's putting it nicely.

One of these days, someone's going to bend some metal.

What happens if you don't land with the 35knot crosswind even with min fuel and have to go around? they made the right decision. and frankly I don't get why people are making a big deal out of it. It's the PICs decision not ATCs.
 
Yep, good for them I say. I've seen far too many airports put into ridiculous configurations simply due to traffic concerns. The ILS 4R into BOS almost always has a tailwind, for instance. Nothing like a 210 knot groundspeed to the marker then trying to slow and not blow everyone's eardrums to hell.

Makes for a stabilized approach when it's down to 1800 RVR...yeah right.
 
Nothing that remarkable. I have had firmly to tell ATC what I was going to do at least a dozen times. The controller should have picked up on it faster, IMO.
 
Declaring an emergency just to get runway of choice sounds pretty weak to me. I would hate to defend myself based on that alone. I assume there was something else going on?

Low fuel...beyond crosswind limitation of the airplane...controller who just wasn't getting the hint...

In the recording I heard there was no talk of low fuel?

If he had time to get everything off the runway one could assume he had enough fuel to get to another airport?
 
I listened to the recording again, the pilots ego is going to cost him. He even ignored missed approach instructions and turned the other way.
 
If he really was that low on fuel. He could have just made this whole thing alot easier by saying that they were really low on fuel and needed to land on 31R instead of pretty much barking orders. Im not a pilot... yet. But it just seems to me that he would have been alot more calm about it. There wouldn't need to be an FAA investigation.
