Student Pilot DUI

My first student i started flying with 3 years ago recently came back and wants to start back up with lessons. He obtained a Student Pilots license and had soloed a few times.

However, about 2 1/2 years ago he received at DUI. He has not flown since but he has not reported to the FAA. I was reading that you need to report that to the Feds within 60 days.

Do you think there will be any penalties on his certificate when he reports it now.

He is ready to get started with lessons again and is eager to get back in the air, i am hoping there wouldn't be a long delay when he reports it.

Well, the student pilot certificate expired 24 months after it was issued. If he was no longer a certificated pilot, I can't see why he would have had any reason to report anything. (Sounds like it hadn't been 24 months yet though).

Only one way to find out, have him get a new medical and report it then (he would need it anyway) Being more than 2 years old, I can't imagine that it be an insurmountable challenge. Joining AOPA and calling them first for advice might not hurt either.
 
Is he over 40? If not, the medical is still valid and he should have reported the incident. At any rate, he needs to report it on the next medical application so they do not catch it when they check the National Driver's Registry.

He must take the arrest and court records with him to the AME for review or the medical will be deferred.
