Ooc, does 121.436 apply to part 135 cargo aircraft that could (in normal configuration) say, hold 19 passengers not including crew if the seats hadn't been removed, or only true pax models?

Asking cause reasons….

121.436 refers to 135.243(a)(1) which states "passenger seat configuration" or "multi-engine airplane in a commuter operation", so I'd be inclined to think 135 cargo without seats in the back doesn't apply. Then again, I'm just a poster on an internet forum so maybe search for letter of interpretation on this.

I am also inclined against it, though for the life of me cant articulate why seats/no seats change the complexity level….gotta love obtuse FARs

Also, no good LOIs showed up quickly…oh well.

Probably the same way that 757 pilots flying freight don't get fatigued, and thus 117 doesn't apply but pilots operating 757s in passenger service can get fatigued and governed by 117. Weird, I know.

Bargaining (and lobbying) power.

Sun Country operates 737s for Amazon under 117. Atlas operates the exact same type (and general route structure) without it.

Reach out to your local FSDO for interpretation. However, my situation was different, I reached out to OKC and my local FSDO and they both got back to me with their interpretation.

It's not perfect, but in general, time that counts requires the ability to scare passengers, in a plane that's big enough.
