How much does arbitration cost? How does one become and arbitrator? Six month wait for these guys services? Dang.

Arbitrators cost anywhere between $800 to $5,000 per day, depending on how in demand they are and what the case is regarding. A low demand (read crappy) arbitrator for a regular case can be as low as $800. A high demand arbitrator (read fair) arbitrator like Rich Bloch can command $5,000 a day for an SLI case, or about $3,000 a day for a regular case.

They're basically all former labor or management attorneys. You have to have a bunch of experience and apply to get put on the NMB's list.

There are also arbitrator/mediators who work directly for the NMB. These guys are on a government salary so while they do well, they don't make as much. These are the ones that get assigned to contact negotiations when the process slows down and one party (company or union) requests mediation. They tend to have a wider background than the freelance arbitrators. In fact the guy w used was a retired Nortwest Airlines captain who got his experience through ALPA committee work.

Those guys aren't allowed to do arbitrations, though. Only mediation. Sometimes you'll see them do the mediation half of med/arb, but then if mediation doesn't result in an agreement, it has to go to a third party arbitrator for a binding decision. The NMB isn't able to do anything that is binding. Hell, even a PEB is just a recommendation.
