medical question 18w.

I have asked around about this already and have received some conflicting information so I just wanted another opinion before I react.

I received a minor in possession of alcohol ticket when I was 19, I am now 25. It was stupid mistake made by a stupid kid, I have grown up a lot since then. Until recently I did not realize that this was actually a misdemeanor offense, I previously thought it was only a summary offense because I was not arrested nor did I have to go to court. I simply mailed in the $25 fine and it was done with. Because I did not believe this to be a misdemeanor I did not report it on my last 3 FAA medicals at question 18w. Now that I realize that it is a misdemeanor how do I go about correcting the issue with the past medicals or what should I do about this situation. My record is otherwise spotless and I have recently began the process to have this expunged from my record. What is the FAA reaction likely to be?

It is important to note that I did not intentionally falsify the report because I believed the situation was only a summary offense and not a misdemeanor. I discovered that the offense was a misdemeanor this week after running a criminal background check on myself (prep for a job interview).

Thank You

I saw your post on APC but I wasn't sure if you're a member on this site. Glad you posted here because you will get your answer from a very credible source.

Just answer the question with good detail when you do the next FAA medical exam. The most that will happen will be they ask for copies of the arrest and court records for review.

Thank You for the response.

I obtained a certified copy of the court record but their is no arrest record because I was not arrested. I called the police department to see if they still had any record of the ticket and they did not since it was so far in the past. They did send me a letter stating that they had no record of any kind on me. I wanted to have both these documents on hand before going in for my medical to eliminate any delays.

In your past experience with this type issue do you think this will cause my medical to be deferred? I have also had it suggested to me that instead of reporting it on the next medical I could write a letter to ok city explaining the situation. Which method do you think will be the best and cause the least amount of hassle and delay?

Send me a pm, l1011.
Also, for clarification purposes. An alcohol related offense is supposed to be reported under 18v? Or does 18v only cover driving offenses?
I was under the impression 18v was for motor vehicle related arrests.

Just report it on the next medical and have the documents available in case the FAA write a letter requesting them. Put a thorough explanation on the Form 8500-8.

Once again thank you for taking the time to respond, your help is very appreciated. I will let everyone no what happens.

Just to update on the situation, I went today for my medical renewal. I called ahead to discuss the situation with the AME and he told me to bring the documents with me. He faxed both of the above mentioned documents to someone in Atlanta (apparently theirs an FAA aeromedical office in Atlanta.) they called the doctor back within 30 minutes and said that it could be issued per doctor tilton (I think it was tilton) and they told him what to wright in box 60 and told me what to write in box 18. I was surprised what he told me to write in the box, they said to put "No Dui, open container of Alcohol under 21". but the ticket was actually for underage possession, not open container. That was it, I got my first class and went on my way.

I hope this is the end of this, do you think I will hear anything else from the FAA of the situation?

Thanks

My guess is a letter from the faa strongly urging you to be careful with
alcohol.

I'll second that. Dont let the letter scare you. But it will basically say stay away from alcohol or we will take your licenses.

You guys were dead on, letter was in the mail yesterday. It basically said I am fine now but stated "you are cautioned that any additional alcohol related offenses may result in the need to be evaluated". I think this is finally over and I can quit stressing over it. Thanks for all the help to everyone that posted.

It is over. Go get'em my man!

Learn and inwardly digest what you've gleaned from this process. Pay it forward.

Blue skies...all the best.

Would this letter I recieved be considered an administrative action? The question was on a application if you have ever recieved an administrative action.

Would this letter I recieved be considered an administrative action?

No. An administrative action is a lower level enforcement and it will either be a Letter of Correction or a Warning Notice. Letters of Correction are sent to a company and a Warning Notice is sent to an individual.

You received a Letter of Eligibility (good letter) informing you that you are qualified to hold a medical certificate. They always warn people to report any changes in health status in these letters.

What is an administrative action, exactly? Is this something that only the FAA can administer, or can an administrative action also be given out by the court?

An administrative action give by the court or MVD. For example, attending driving school for a ticket is an administrative action if required by the state.

So, if the state requires attendance of a course it is an administrative action. Then, would a Minor In Possession ticket that is dismissed following attendance of a class also an administrative action?

Doctor can correct me if I'm wrong but I'm pretty sure the is a question on the medical asking if you ever attended a diversion program in lieu of conviction or something along those lines
