Serious question, do you think "we belive" would stand up in front of an NTSB judge.

The NTSB has a record of upholding the FAA interpretations of its own regulations more often than not. I read somewhere maybe 75% of the time? In fact, there was a ruling they made a few years ago that caused some consternation within the aviation community where the NTSB said point-blank that the FAA was in the best position to interpret its own regulations:

Serious answer: By the time it came before an NTSB judge, the "We believe" would disappear and it would be come "it is."

By federal statute, the NTSB is required to accept the FAA's interpretations (so long as not completely out of whack), and by case law, the FAA can present its interpretation for the first time when it goes after a pilot's ticket.

Worse. In the case you are referring to, the NTSB thought the FAA's interpretation was very wrong and went the other way. The FAA appealed to the US Court of Appeals. It was the Court of Appeals, not the NTSB, that said point-blank (based in part on a federal statute) that the NTSB had to defer to the FAA's interpretations of it own regulations unless it was (my words, not the cases) completely ridiculous.

Good thing you know not what we talk of. I had a friend that had his certs revoked for taking off in his extra with smoke on. It's a long story. But I was at his hearing. Lets just say the FAA's expert witnesses aren't exactly experts. Especially that guy who's last name rhymes with bus and expensive ring metal, and his 1st name rhymes with Ron.

Just for the point of being one of those guys, I did find one mispelled word (or misused depending on how you look at it) in the second paragraph below the portion of the letter that 400A posted here.

I am only pointing it out because you have a very nice and professional looking site.
