He's not hoping you'll fail. But an illegal strike is going to more harm than good... And that betterment of the industry you talk about is non-existent in this case. I'm sure @ATN_Pilot is hoping he's wrong, but I doubt he is.

The real risk is bad case law that makes the RLA even more draconian for labor. And then there's the possibility of an injunction that places onerous restrictions on you from here on out. Ask the UAL guys how great that is when you can't even send out an email without an army of lawyers approving it. And then another risk is a big fine. Ask the APA about that one. I believe theirs was $40 million. And finally, the risk of prison time for union leaders. Lots of risks. Little hope of success.

I'm not going to pretend to know what I'm talking about, but since you haven't been released to strike I'd assume that's pretty illegal. Maybe it depends on the judge, but the consequences can be pretty terrible... Huge fines, that you guys will be responsible, and hell there could be jail time for the organizers... It's happened in the past...

That's what worries me. And the fact that @ATN_Pilot is unsure makes me worry for others that may face this dilemma.Very good question.
That is fantastic but you are depending on others to hold the line as well so it'd be best to not surprise other pilots outside your group.The only ones really caught by surprise so far are those who don't work here (and aren't abreast of our situation) and the shareholders who management recently told that a strike isn't likely. That's why we are confident this course of action will be successful.
