HIMS AME in Florida

Dr. Forred:

Other than Dr. Susan Diaz in Miami, is there another HIMS AME in the state of Florida that I can have my records sent to to determine my eligibility for the Special Issuance? Just got off the phone with a rep from the Medical Appeals Office in DC and was told that the last info of any clinical material that was entered into my medical file was back in May '09....the denial letter from Dr. Tilton for the unrestricted. I've completed what was recommended by Dr. De Voll and that being a 6 month IOP and then started an aftercare program and have continued in that aftercare program to this day. I have over 2 years of credible medical evidence of continued sobriety.

I've signed releases to have information sent to Dr. Diaz's office, including my entire medical file but have received no response whatsoever from her. It was suggested by the rep @ the MAO in DC that I contact the psychologist that conducted part of my HIMS eval back in October to see if he and the HIMS psychiatrist have worked with any other HIMS AME in the state to have a look at my records.


What are you thoughts?

I''l try Dr. Blair in Vero Beach, FL since that is the next closes HIMS AME to me. In addition, I work in Port St. Lucie and the flight school I plan to attend is in Fort Pierce.....Ari-Ben Aviator.

Hey Doc:

I spoke with Dr. Fries on the phone today. He informed me off everything that I would need to know if he consented to sponsoring me in the HIMS Program. I had mailed a letter to him today, (1/7/11), delineating what has transpired since my initial application back on October 3, 2007 up to the present. During the conversation, he asked if I were able to fax the letter and I told him, "no problem". I can't begin to tell you what a feeling of encouragement I felt on the phone talking to him.

Thanks for your help. I'll keep you posted and let you know if it's yea or nay.

Well, I dropped off my medical file and other correspondences that weren't part of my file to Dr. Fries' office yesterday. He chuckled at the fact that he had alot of reading to do. :laff:

He stated that he would get in contact with those persons that he needed to talk to about my situation including the (HIMS evaluators -P&P eval doctors), IOP counselors @ the Hanley Center in WPB, FL and Aftercare individual and group counselors @ Recovery Associates in Lake Worth, FL. He said that he would get back to me either at the end of next week or the following week and let me know if he is able to help me. My mind is moving at about 1000 miles a minute however, I'm feeling optimistic.

Great information to have and very informative. You can't get any more complete than that. Hopefully, it'll help others.

Btw, I PM'd Doug and SteveC asking if they could make it a "sticky". That way if another thread is started about this matter, the OP can be directed to that sticky. Weren't sure if you had the capability to do so.

Good morning:

On Tuesday, March 15, 2011, @ approx 3:52 pm in the afternoon, I got a call from the HIMS AME in Vero Beach, FL, Fr. Ian Fries, who was willing to sponsor me in the HIMS program told me that although I had met all of the criteria that the FAA had set for the conditions of the HIMS program, that I would still be denied a medical because the FAA said that I had an anti-social personality disorder. This is in spite of the recommendations of two HIMS evaluators, Dr. Carlos Porges and Dr. Raphael Perez-Espejo, a neuro-psychologist and a neuro-psychiatrist respectively, that I be medically certified, 3rd class, to start my flight training. Their diagnosis was that any characteristic traits of the personality disorder where non-existant due to my abstinence from alcohol abuse and that with further supervision, I could apply for a higher class medical in 12-16 months. I thought that I was finally on my way.

Dr. Fries informed me that he had been on the phone with the doctors in Washington DC for the last 1 1/2 weeks. This includes James R. De Voll, Michael Berry, Dr. Gitlow and Charles Chesanow. He said that he posed the question as to why would they allow me to continue on in this process knowing that they would in the end deny me on the basis of an anit-social personality disorder. He said that he got no reasonable answer.

The thing that gets me is that if the doctors in DC knew from the time that I got my initial denial letter from the Federal Air Surgeon in May of 2009 that an anit-social personality disorder was in fact a permanent disqualifer, why was I led to believe that by meeting the criteria for the HIMS SI was all that I needed to do? I have spent the last 3 years of my time, effort and resources pursuing this. I'm considering having an attorney looking into the fact to see if in fact the FAA intentionally mislead me to believe that I would be certified. Every correspondence that I got after the initial denial letter was aimed at the HIMS (SI) process and the criteria that had to met. There was never anything mentioned about antisocial personality disorder and it being a permanent disqualifier. Absolutely nothing.


So, as a long standing member of JC, this will probably be my last post for some time. I wanna thank everyone for their support and advice. For me, aviation has strictly become a hobby. The quest to become a paid pilot is over.
