Hey Doc,
Recently pulled over with a BAC of .16. I am about to report to the FAA. Is there any chance of keeping my medical the whole time? Is the defferal an automatic suspension? Do I have to stop instructing? How long do they pull it for? Any info/advice would be appreciated.

1) You must report it to FAA Safety within 60 days.
2) Report it at the next medical. You will need to take copies of the police arrest record as well as the court documents to the AME for review and submission to the FAA.
3) Since it is above 0.15, the FAA will probably require you to get a substance abuse evaluation from a psychiatrist or psychologist or a DOT approved SAP. Depending on that evaluation, you may be required to contact a HIMS AME and get into a monitoring program.
 
My previous flight instructor just got a dui Friday night. He had a BAC of .10. Luckily he doesn't use this site, but I'm trying to find info to give give him advice. He already got started doing the required reporting paper work but is really in question as to the status of his certificates and medical after its all said and done. What is the standard protocol the FAA will do to him with a a low BAC and nothing else on his record I don't think. He is a commercial pilot and instructor, when convicted do you think he will have his medical pulled? He is under the impression he is never going to fly again.

I'm really just trying to help him out, since he was there to help me get most of my ratings.
 
He is required to 1) report the DUI to the Safety Division at the FAA by letter:
Security and Investigations DivisionAMC-700P.O. Box 25810Oklahoma City, OK 73125-0810
2) He must report it on the next medical. He is required to take the police arrest record as well as a copy of court documents to the AME. The FAA also wants to see a detailed personal statement about his alcohol use. The AME can issue the certificate but must forward all of the documentation to the FAA.

He should be able to keep his medical even if he has to jump a few hoops but finding a job will be tough when he can't go to canada
 
Thanks for the information Dr. Forred,

He has been freaking out all weekend. I'm trying to tell him that I'm sure it will work out. I know the information on Canada, but I guess he will be flight instructing for the next few years. What are the chances they pull his medical? I read something about if the person's BAC is below .15 then it is up to the AME for review.

I will tell him about AMF. I'm sure he won't mind that down the road.
