Diabetes and sport license

Question brought to me by a fellow CAP member: can someone who was denied a 3rd class medical in 1998 due to diabetes. Can they now get checked out for a sport pilot license?
 
Nope, they would have to get their medical back and then let it expire. Most recent cannot have been revoked or denied.
 
How would one get their medical "back" if it was denied the first go-round? That seems like a catch-22 for those who want to go for a sport license.

This individual has, according to him, had their diabetes under good control since the diagnosis. The diagnosis was made during the FAA medical exam while he was a student pilot.

Is there some sort of appeal process or anything else?
