Was your phone volume turned up?
I'm not sure why the volume wasn't audible. I can help with the atc mute part though. The early ones they shipped has the auto mute feature. Every time there's a comm (atc or intercom) it mutes, then slowly increases the volume once the comm stops. So if it's busy, it's super annoying. On the headsets they ship now there's a way to turn the auto mute off. Once you pair your phone, a simple tap of the Bluetooth button and you'll hear an audible set of beeps. This means auto mute is turned off. You have to turn auto mute off every time you pair/re-pair your phone. With auto mute off you set the aircraft comm volumes and then set your phone volume so you can still hear any comms. If yours wasn't shipped with this feature, contact David Clark and they'll set up a way to ship them the headset. I had to send them mine to have it updated. They just have to swap the board out with a new one. Turn around time was less than a day, the day they got it they sent it back. It's completely worth whatever down time to get this new feature. It made a great headset perfect. I love my Pro-X.
But if something is wrong with that function, it could mean something else is also not working properly. I'd send it back.I just tested it at my computer desk. Something is messed up with the bluetooth. Initially it will play the music loud and through both ears. If I tap a volume (either ears volume) on the headset the left ear will cut out, the right ear goes quiet even at max volume, and I can only control the right ear volume (only hear the beeps on the right ear). Turn the bluetooth off or reset the headset and everything is back to normal. Cell phone volume is all the way up. It definitely does not have the auto mute function.
I've never had any other problems using the headset for its normal operation. I may send it back, may not. I don't really care about the bluetooth feature.

BTW, I have one of the early ones with the auto-mute and decided not to send it in for that update since I don't listen to music that much and, when I do, auto-mute doesn't particularly bother me. Mostly I like the Bluetooth to call for void-time clearances and to call home home while taxiing at the end of a flight.
