Collapsed Fixed Landing Gear - Incident Report?

While lining up on the runway for takeoff today, the right main fixed gear fell off an airplane that I was flying - the plane dropped to the runway and came to rest on the wing tip and tail.

I think landing gear incidents are excluded from accident reporting but should it, since it was a structural failure of sorts, be reported or not? I'm not sure if the damage exceeds 25K or not yet.

The fire department guys that responded suggested that I should file a report but some of the airport maintainence staff says that it is not required.

Is there a downside to filing a report if it is not required?
 
what type of plane?? guess we had a warrior II that had the same thing happen to it. nut fell off the scissor arm assembly and as soon as the plane lifted off, plop, the strut seperated and was dangaling from the brake line.

I think you may be referencing NTSB part 830 about the $25K thing. Thats damage to property other than the airplane. NTSB 830.05 clearly states you must report a flight control system malfuntion or failure. You didnt have anything that constitutes a NTSB report. Looking at what happened, you are not obligated to report this. It may open a can of worms if you do, IMO.
 
It won't open any can of worms, the NTSB can't violate your certificate. If the FAA is coming after you because you did something wrong it's going to happen anyways.
