A.I.G refuses crash claims

In a case where a family's vehicle went off a the road into a body of water, but all got out OK after a traumatic moment ... would an insurance company typically pay for mental health care?

There is a difference between you driving yourself somewhere, and putting your life in an airline's hands. AIG had better make sure they are sure about their position here, because NY is a tough place to do business if you are an insurer.
 
When a homeowner has a burglary or a driver has a crash, all it normally takes is a call to the insurance company and a description of the loss to activate the policy. But aviation liability insurance is different. It is activated by a finding of negligence on the part of an airline. If there is no negligence, then arguably there is no liability, and no obligation to pay claims.

As much as I hate insurance companies, the policy is what the policy is, and it states right now, there's no negligence, so there's no obligation to pay. US Air, the airline, forked out $5000. . . Nice "gesture."

Have a couple of other questions. Who pays for lost luggage, etc?

Have a feeling we'll be seeing more insurance kiosks popping up at airports in the future.
