Scenario:
A DPE does not possess a current medical, can a student pilot conduct his private check ride with the DPE?

According to 61.47, it seems that can happen, since the DPE does not act PIC unless they agree to. This is a new scenario, so I was wondering if this interpretation is correct.
 
I agree with that, unless the FAA says somewhere that a DPE has to hold a current medical to fill that role.
 
:yeahthat:... He is just an "examiner". But then if he has to take over... well that might be a whole different can of worms...
 
I know a DE who let his medical expire and has stopped giving checkrides.
He's been doing this for 20+ years so I think he knows his stuff.

So the IR pilot says no! :)

I would opine that for a Private ride, the answer is NO. For other rides (instrument, commercial, etc), yes. The DPE is PIC for the Private ride.
 
Also, it seems intuitive that an examiner could not do this for a private pilot. If they agree not to Act as PIC then who would? I don't think the student could because they do not have that ability yet as a student pilot, which is all they are on that ride.

I brought this up because someone I know assured me this scenario was possible. They used 61.47 to validate their claim, thanks again tgrayson for verifying my suspicion.

Watch for that intutitive stuff.

Look at 61.47 (the title of this thread). By rule, 61.47(b), the DPE is not the PIC on a checkride unless he specifically agrees to be. Most will not. The purpose of the reg is to give the DPE a wee bit of liability protection in case of a mishap.

The applicant is PIC. Even on a private checkride. That's covered by 61.47(c) which in this case allows the student pilot to carry a passenger (the DPE), although it applies more generally (think ME add-on checkride).
