Greatly discouraged today....

So I applied and interviewed for a small cargo company (Don't want to mention names yet). The interview went great and I was told I was the ideal candidate and they could work with me on my drills (my 1 weekend a month for the Marine reserves). I called back today to follow up and was told everything was fantastic but that the owner wasn't sure if he wanted me due to my being in the reserves! Here I am thinking people look up on this stuff and it bites me in the rear! :banghead: So now the chief pilot is trying to convince the owner of the company that its not that big a deal. I guess the point (aside from me venting, which I'm sorry for) is, will being in the reserve kill my chances at jobs until I get out? Wasn't sure if this should be in the military section or not, sorry if its wrong. Just feeling down and want to be reassured i guess. :(
 
Is that even legal for them to do? I didn't think so.

Gee. If only we had a labor lawyer around here....:D
 
Nope... not legal:
Section 4311(a) of USERRA provides as follows:
"A person who is a member of, applies to be a member of, performs, has performed, applies to perform, or has an obligation to perform service in the uniformed services shall not be denied initial employment, reemployment, retention in employment, promotion, or any benefit of employment by an employer on the basis of that membership, application for membership, performance of service, application for service, or obligation."
Section 4311(c)(1) further provides:
"An employer may not discriminate in employment against or take any adverse employment action against any person because such person has taken an action to enforce a protection afforded any person under this chapter, has testified or otherwise made a statement in or in connection with any proceeding under this chapter, has assisted or otherwise participated in an investigation under this chapter, or has exercised a right provided for in this chapter."

These two provisions provide a very broad protection against employer discrimination, much broader than the VRR law provided. The second provision prohibits, for the first time, reprisals against any person, without regard to military connection, who testified or otherwise assists in an investigation or other proceeding under USERRA. (Section 4311)

Man, I love you guys (and gals) on this website. :) But what can I do if I get turned down? I mean, it says all that but in all honesty, can;t they just say I was turned down for other reasons?

Doubtful. Like the ruling says, "These two provisions provide a very broad protection against employer discrimination." At this point, they would PROBABLY hire you if for no other reason than to prevent a potential lawsuit. Likewise on if they decided to fire you--unless you did something EXTREMELY negligent or VERY well documented continual poor performance, you'd have grounds to claim military discrimination. MOST employers are VERY sensitive to that. They don't want to risk getting on Uncle Sam's bad side.

thats what I always think. if they don't want someone due to color, religion, miiltary status or whatever it is, all they need to say is 'oh we can't accept your application at this time because we were looking for somoene with more experience'

that always made me wodner.

yeah but would you want to work for someone after you say 'you HAVE to hire me' I sure as hell wouldn't
 
If you get turned down for "other reasons" then the job wasn't good enough for you man! Some else will come up and it will be better then the first one! Don't let it get you down!!

That is what I was about to say. Wouldn't want to have to go to work and the boss already hates you because he knows he can't fire you.

very true. maybe write a letter to the boss, point out this rule and sign your name with your rank etc like the marine you are. Also tell him you are no longer interested in the job.

maybe it will make him realize what he did was very wrong. Also makes you the better person.

The principle behind the story:

You interviewed for a job - did great - exceeded the qualifications - beat out other candidates - wowed the chief pilot enough to make him argue with the man that cuts his check.

Now move on right now - dont dwell over that last little bit. Move on knowing you did right and deserve your spot. So go get it! Right now - this second start applying. Get this little thing out of your head. Dont make it a bigger part of your life than it needs to be by filing complaints and yada yada. Go get yourself something better.

Before writing any letters, I would give it a little time to see if they offer you a job or tell you straight up that you are not hired.

That really sucks that they would not want to hire you because you are willing to serve our country. Let me thank you for that and good luck with you job search.
 
From what I've seen, most airlines and operators LOVE reservists. Unfortunately, that one didn't. :(

What are your quals, we'll find ya something! ;)
 
Deport that SOB and send him to Iraq. Arseholes like that don't deserve to live in the USA!:mad: After all, isn't it the men and women of the armed forces who served and gave thier lives that gave this fooktard the right to the pursuit of happiness? Brings a tear to my eye to think that 4 gens of my family have served this country in 4 different wars so this asshat can deny someone a job because they serve!

After 30+ years in this business, some of it working for owners of small cargo companies I do know one thing. Owners of small air cargo companies aren't "normal" people. Think of the bar from Star Wars. Then don't let anything one of them might say or do discourage you.

Thats the thing. This place was hiring with a multi-comm off the bat for SIC turbine. I have money issues (long story with the parents) and don't think I can go to CFI school for a while. If I could go to piedmont or something I would. Guess I'll just have to see. But again, thanks a lot Doug for this website and all the great people on it. :rawk:
