True. The first amendment gives you the right to free speech but it doesn't give you freedom from criminal or civil liabilities as a result of such.

Read the first amendment and tell me who it applies to.

It says Congress shall make no law.

It doesn't say anything about private individuals or companies.

I'm not saying that Ornstein isn't a prick, I'm just saying he's not covered by the first amendment.

One of these days at a JC event, I'll tell you what a tool he was at an awards ceremony I attended as well as how inappropriately his PR people acted.

The First Amendment only guarantees free speech in relation to the government. Private entities can censor 'till their hearts are content.

That being said, in my opinion, JO is a • bag of the highest order and one can only hope that one day he gets exactly what he's given all these years.
 
The First Amendment may not apply to JO, but it certainly does apply to the government court he's suing in. Private citizen or not, I can't use governmental institutions to suppress your free speech rights.

No, but anyone can sue for almost anything (hence the need for amjor tort reform, which I'm sure your intimately familiar with). Whether the plaintiff wins is another story entirely.

However, in this case big corporation vs. mesa pilot. It doesn't take a much to pick the deeper pockets.

Actually it's Mesa Air Group v. Aloha Airlines pilot.

Hawaiian Airlines and Aloha can't handle the competition so Aloha pilot puts up a website slamming Mesa. Mesa says its defamation. Aloha pilot says its not. The courts will decide.

It states that he now flies for Aloha. I assume (although I don't know) that he put that website up after he went to Aloha.

Ever since mesa's GO! Airline entered the Hawaiian market the fighting has been nasty. I wish Mike good luck in court on Monday, but I can't say that putting up that website was the smartest thing to do, unless he has someone covering all his legal bills.

Very true. This sort of case is why many states have enacted anti-SLAPP (Strategic Lawsuit Against Public Participation) statutes which allow for damages against a plaintiff who is bringing a suit primarily to intimidate and silence a less powerful critic. California (of course) has the best example of such a statute, but about half of the other states have them as well. More states should.
 
I get a "I'll sue you if you don't do XYZ" email threat about every six months.

The latest was some corporate jet owner that thinks someone on the forum slighted him. Written in ALL CAPS too, interesting.

I think what happened is that Mesa went into negotiations with Aloha and signed a non-disclosure agreement. Mesa then used the proprietary information in violation of the agreement to start Go!.

Or something to that effect:o
 
JO still owes me my last pay check!:mad: He is the biggest ####### evar! When his attempt to buy Indipendance Air failed and they finally had to shut down, he made it know to HR, all VP's and managers that Mesa would not hire anyone who had been employed at Indy Air. He had to recind that order when we started getting short on mechs, pilots, and other jobs.
