True. The first amendment gives you the right to free speech but it doesn't give you freedom from criminal or civil liabilities as a result of such.
Leadership? Umm.. no.
Tyranny, yes.
The First Amendment may not apply to JO, but it certainly does apply to the government court he's suing in. Private citizen or not, I can't use governmental institutions to suppress your free speech rights.

Actually it's Mesa Air Group v. Aloha Airlines pilot.
Hawaiian Airlines and Aloha can't handle the competition so Aloha pilot puts up a website slamming Mesa. Mesa says its defamation. Aloha pilot says its not. The courts will decide.

No, but anyone can sue for almost anything (hence the need for amjor tort reform, which I'm sure your intimately familiar with). Whether the plaintiff wins is another story entirely.
