Unfortunately, even if the FAA investigated this guy, yanked his examining authority, and you took the ride with the FSDO and passed on the first time, there's no way to get this off your record. Until a couple years ago, no one would have cared, but in recent years, especially with regard to the regional airlines, busted checkrides aren't the best thing, as the airlines view it as a potential liability and media fiasco.
Since you're already almost done with the rating, I'd say that you have more to lose by going to another examiner now (by risking failing things that you already successfully completed the last time around), so I would just suck it up, finish the rating, and move on.

. On other Websites there is a big Note like "post is older than... " on top of the page. Might help
