Quality of life is, of course, dependent upon whose life you're discussing. I want very much to wind up at an ACMI or even (shhhhhh!) UPS, but the thought of flying as a subordinate to someone else, no matter how crusty and Badass, gives me the howling fantods after 5k of doing it My Way.

True dat, I flew with some really crusty badasses, and prefer to make my own decisions. The hardest part is when you disagree with a crusty badass but you know that he's still going to do things the way he planned, and you have to live with a decision you don't get to make. As a good crewmember you say, "What do you think about this?" As PIC you say, "screw this I'm headed for my alternate." Arrogant? Maybe, but frankly, I really really like making my own decisions.

Indeed. I like to think that when my time comes (God willing and the crick don't rise), I'll go read some of my own posts about shutting up and learning and come out the better for it. But it will be a struggle.

An April 2009 prospectus last year noted that if either Mesa or its codeshare partners (US Airways, Delta, United) file bankruptcy, the other party can terminate. Paul Skellon wasn’t able to comment on whether this clause was still in effect. Update: I heard back from Brian Gillman, Mesa’a EVP, General Counsel, and Secretary and he confirmed that those bankruptcy clauses are unenforceable. They are only included in case the laws change in the future.

Why in the world would general counsel for a company as large as Mesa make a quote as stupid as that to a blogger?

I'd wager that if MESA were looking to get out of the deal, the interpretation would be different. I'm with jtrain on this one, though. It's really too early in the game for ANYONE to be making statements like that, be they CEOs, legal counsel or pilots talking out of their asses. IMO, another blogger that's trying to generate traffic to his site.

It's not that I think it's too early; Mesa might very well believe that these things are unenforceable and thus, they'll be in great shape.

What I CAN'T see is an attorney tossing that kind of information out there unless it's little more than posturing.

And it's a wonderful exhibit on when management thinks a contract is enforceable and not. . .I'm sure we could compile quite the list of "enforceable" and "not enforceable."

Mesa has it's own way of interperating contracts. If it benefits MAG; they'll gladdly break any contract it can. If it's someone else who's not honoring their contract with MAG, they'll do whatever it takes to win and be right. Look how it treats it's agreements with ALPA; then look how it's defending it's contract's with DL and UA; to the very last tooth and nail!

Uhhh, That means that the court is allowing Mesa to continue to pay their employees what they made before the filing. First day motions are really just a matter of procedure to allow the the company to operate day-to-day as they did before the filing.


Prepetition wages are the wages that the employees made a week ago. Noting more nothing less. Nothing to get worked up about.
