A captain where I work just had this happen.
Climbing through 6000 feet, departing CLT the FA called up and informed him that a passenger was watching a video on their ipod and had been asked to turn it off multiple times and so far had ignored the instructions. The FA then handed the passenger the "card" (basically a laminated sheet that informs them that they are disobeying a direct order from a flight crewmember and if they continue to do so they will be subject to federal penalties).
According to the FA the passenger never read the card and said "what are you going to do, go back to Charlotte and kick me off?"
The captain thought that was a great idea, so he did.
We (as flight crew) really need to be doing this sort of thing more often.
