Yes, another expired ATP written question...but different (135).

First of all, I took my ATP written in 2007 just prior to joining a 121 carrier. Was furloughed, carrier no longer exists.

I know that if I were to take an ATP check ride part 61, it would definitely have to be re-taken.

Just hired by a 135 operation. They are sending me to an approved course for PIC type rating.

From what the regs state, it appears that my expired ATP written will be acceptable:

61.39 (b) - Notwithstanding the provisions of paragraphs (a) (1) and (2) of this section, an applicant for an airline transport pilot certificate or an additional rating to an airline transport certificate may take the practical test for that certificate or rating with an expired knowledge test report, provided that the applicant:
(1) Is employed as a flight crewmember by a certificate holder under part 121, 125 or 135 of this chapter at the time of the practical test and has satisfactorily accomplished that operator's approved--
(i) Pilot in command aircraft qualification training program that is appropriate to the certificate and rating sought; and
(ii) Qualification training requirements appropriate to the certificate and rating sought;

Planning on calling the FSDO on Monday, but wanted to see if anyone has been in this situation before and had an official interpretation or success with this.

Most everything I've read is people in 121, not 135.

I don't know where I read it but I believe it can expire while employed and still be used, but if you are furloughed then it's useless. If you then get hired elsewhere that hire date counts and therefore the written expired before you were hired. I can't find where I've read that.
 
Spoke to local FSDO today. They said it is exactly as written (61.39 (b)) and confirmed that expired written is acceptable for 135 PIC/type rating/ATP check ride. As long as I am employed by a 135 carrier at te time of the check ride, it is valid. They said if the examiner balks, to have him/her call them for clarification.

He said it is not valid for part 61 or SIC/ATP check ride at 121 carrier.

So FWIW, that's the FSDO interpretation.
 
I went through this a year and half ago. I had taken my ATP written prior to being hired at Pinnacle. Three and half years later, I was hired to fly left seat in a Citation. Flight Safety in Wichita said the same thing as your FSDO. Basically, the reg never says "continuously employed." It only says employed at the time of the checkride and going through an approved training program.
 
Ahh, I stand corrected. Of course I'm sure if you ask a different FSDO you'll get a different response as well.
