VFR-day type certification instruments or equipment

Another question for everyone:

When determining if you can fly with inoperative instruments or equipment without the use of an MEL, 91.213 (d)(2)(i) states that the inoperative instruments and equipment must not be:

"Part of the VFR-day type certifications instruments and equipment prescribed in the applicable airworthiness regulations under which the aircraft was type certificated".

Can someone explain that to me? What it is exactly and where I would find it? I understand where to find part (ii) kinds of operations list, part (iii) 91.205, and part (iv) airworthiness directives... but I'm not exactly sure what part (i) is referring to, or where I would find it. Thanks in advance!
 
If the equipment is required on the type certificate data sheet then it needs to be operative. If it is required and is inoperative then the plane is no longer airworthy due to the fact that on the airworthiness certificate it states "conforms to the type data certificate and is in condition for safe flight." You can get a type data certificate for your plane off the FAA website. I hope this helps out.

Technically, it's referring to the aircraft certification regulations that were in effect when the airplane was certified. The current regulations for certification of normal, utility, acrobatic and commuter aircraft are under FAR Part 23. But, as you know, regs change. On top of that, many of the airplanes we fly were certified under the older Civil Air Regulations (CAR) Part 3 rather than FAR Part 23.

Obviously, that's a problem. I don't know anyone who even has a historical FAR that shows certification regulation changes through the years, let alone a copy of the CAR.

Fortunately, from a practical standpoint, there are two sources, that between them, probably cover almost all of what the certification regulations required at the time the airplane was certified.

ajf mentioned one - the Type Certificate Data Sheet.

The other is in the equipment list for the aircraft - it would be unusual for a piece of equipment that was required by the certification regs to not be marked "Required."
