Student with a missing right arm

I have a student missing his right arm, but has a prosthetic. Trying both seats it has been easier for him to fly from the right. The FAA said they were going to make him fly from both seats for his checkride. My question is, where in the FARs does it say he must fly from right and left seat? The POH for the C172 doesn't say that the PIC must fly in the left seat and I haven't found anything in the FARs.

I'd appreciate any advice anyone has. Thanks.

Per the PTS "any areas deemed necessary by the examiner"

Sounds like a BS test. He should sue for discrimination!
 
As long as he demonstrates good pilot technique from the right side, I see no problem. Try a different examiner or talk to some.
 
I have a friend that is missing his right hand too. He is a CFI and is trying to get his 1st class SODA so he can apply to the airlines. Amazing pilot. The FAA has been giving him a difficult time in getting his SODA too. I feel for him.
 
Just to answer the question: 67.313(b)

That would exclude the guy from any kind fo flying at all. I know a guy who is the CP of a charter compnay, who only has one arm. He walked into a prop at night and it took of one arm and half his ass! Sounds to me like he needs to find another DPE. He will either bust his ride taking it with that guy, or have to sue.
 
Don't forget the girl who flies the ercoupe that has no arms at all... She was a big story last year flying with her feet. If you can legally solo, you can legally get your ticket.
 
Thanks for all the input, I really appreciate it. My student has completed everything and is doing his SODA in conjunction with his checkride. This means he has to use the FAA and not a DPE. For a SODA he has to go through the FAA there's no getting around them with a DPE. He is a veteran and I just feel like its adding insult to injury making him fly from both sides.
 
So he passes from one side and not the other, what do they do, stick a limitation on his certs that says 'must fly from right seat?' It says right in the regs/pts that areas of operation can be omitted if at the discretion of the examiner they do not pose a safety of flight risk, and such limitation would be placed on the cert.
 
As much as it pains me to say it, but if you can, find a different FSDO to work with. I know that certain FSDO's are more open to working with you than others.
 
seriously, before you have him go off and get a SODA, talk to Sean Odonnell. My opinion is best to go in armed (no pun intended) before coming out eaten.

Talk to a guy who does this for a living so you can get all your facts straight before you put your student through a ringer that is unneccessary.
