Not too long ago there was a post on JC about a Massachusetts anti-GA group known as "Stop The Noise" (http://www.stopthenoise.org/). This became somewhat of a heated discussion about this groups trying to impose their beliefs on the GA community as a whole. The FAA recently ruled in favor of GA concerning this groups trying to get all aircraft to put their N-numbers under their wings. As a current federal employee myself, I'm very happy to see that someone in D.C. is actually thinking things out before acting on every riduculous complaint that they receive. Keep up the good fight AOPA!

Agency affirms AOPA argument

May 4 — The FAA has turned down a petition from a Massachusetts anti-noise group to require aircraft owners to put two-foot-high N numbers under their wings. As AOPA had argued in its comments on the petition, the FAA said the issue had been debated, studied, and decided years ago — the current 12-inch-high numbers on the fuselage are sufficient.

The FAA concurred with AOPA's comments that the issue had been addressed years ago and the current 12-inch numbers are appropriate. In its denial letter to William Burgoyne of the group Stop The Noise, the FAA said, "In considering the change to the 12-inch numbers [on the fuselage], the FAA worked extensively with law enforcement agencies, FAA field inspectors, the U.S. Customs Service, the U.S. Department of Defense, the FAA Air Traffic Service, and private citizens and citizen groups with concerns similar to those of your organization. Those groups agreed with the FAA that it was important to make the registration marks more visible. After extensive deliberation, the FAA decided on the 12-inch criteria."

"Stop The Noise has shown that it's willing to sue pilots even if the pilots are operating in full accordance with regulations," said AOPA Director of Regulatory and Certification Policy Luis Gutierrez. "This petition was just a thinly veiled attempt to make it easier for the group to go after other pilots."

AOPA has offered financial help to the four pilots that Stop the Noise has already sued and has provided significant legal research to aid in their defense. The cases against the pilots have not yet gone to trial.

The really sad thing about it is the fact that 2 if not three of the pilots sued have stopped flying. Even with the AOPA helping pay the legal fees they didn't have the money to do both. Hopefully the will be able to start again. I'm origonally from Mass, although not that part. Where it is used to be open farmland that was sold to developers when the farms shut down. So these people move out of Boston to get away from the noise. So they think that just because they paid several million dollars to leave the noise behind, they can attack anybody who brings the noise to them. The basis of their argument was that they "own" the land, and the airspace above it up to "infinity" I believe. Talk about a bunch of pompus asses. The really funny part is that I have a friend that lives near there on the edge of another development. He has lived there for years, and is now really upset by the light pollution (and ironicly the additional noise) that these houses are creating where there used to be only fields.

I think the Stop the Noise people wanted N Numbers on the bottom of the wing so they can see who is flying above. This group feels that they own the airspace above thier homes up to and including infinity.I think they anticipated the legal system to agree with them and they were trying to get the jump on the N Number change.When someone overflies thier airspace, they can charge them.

This is really bad. I don't see the FAA approving the groups efforts to own the airspace above thier houses, but it does prove that lawyers will take any case.

It's my understanding that anything above 500' AGL becomes property of the federal government, and they are the ones that regulate it (read as the FAA). I don't see them giving up their rights to this chunk of the earth anytime soon, nor do I think they should due to people like Stop the Noise.

Just wait until the idiots living around Scottsdale (AZ ) Airport begin doing the same thing.

At least if they sue the corporate jets, the corporates can defend themselves.

Love to see them sue when Gulfstream G-IV, N1KE lands.....

Yeah. When I worked as a lineguy at Corporate Jets at SDL, I serviced that plane many a time, among many other corporate types. Forgot on the G-IV/G-V.

The irony is, these people would gladly buy NIKE shoes, but don't appreciate their jet, among many others.
