Sex offender working as a CFI

I recently discovered a CFII I know, one who in my opinion is one of the best out there, was convicted after admitting guilt and served time, for aggravated sexual assault on two boys ages 13 and 14. After reviewing the regs I saw that the ATP is the only rating requiring good moral character. How is this conviction not a disqualification for a CFI? How do you justify putting this former teacher back in a position of power over young adults?

A lot happens in court, which can corner anybody to admitting guilt.

There are so many reasons for admitting guilt, especially in trials like this.

I say let him live his life.

I believe he should be able to make a living flying, but to give him a position teaching teenagers? Seems very wrong in my eyes.

I'm mostly with you on that.

Uhm, well, that would be because they are different certificates, of course.

A felony conviction is not necessarily disqualifying in the eyes of the FAA, according to the 10 minutes of reading I've done on this topic this afternoon at your implied behest. TSA is a whole different matter, mind.

Are there any laws or court orders that prevent him from interacting with younger individuals? If not, it appears as if he has done his time and this should not be an issue.

Pretty much. That pilot may have difficulties moving on to heavier equipment depending on how precisely the TSA threat assessment process works and what is and is not considered disqualifying.

One of my mothers neighbors ended up on "the list" when he urinated in his own fenced backyard and a parent called the police about what the children "might have seen" through the knots in the wooden fence.

It's mighty easy to get yourself on that list so Id be reluctant to generalize too much.

My concern is that you have no idea if he was an innocent man admitting guilt, because of legal reasons.

Who knows the boys could have lied and made up a story. All I am saying who knows, and I will not judge someone based off that. Too many what ifs.

If I caught him with child porn, now that's another story.

He was also caught with child porn and books on pedophilia.

Would you guys be ok with Sandusky getting out and working with children again?

Now that changes a lot for me at least.

Read post eight.

Also please include more information like this next time if we are supposed to discuss it ;)

I find the current "witch hunt" mentality in this country to be very disturbing.

I say mind your own business—don't send your kids to him if they're under 17, and if you have evidence of any further crime on his part I'm sure the police would be quite interested...but otherwise leave the guy alone. I'm guessing that CFII isn't all that close to the top of the list for 'dream child-molester positions', and you can pretty much draw a parallel between just about any job and the possibility of exposure to children.
What would you prefer? A public stoning to satisfy the mob and to protect our fat, unhealthy, overprotected children from his potential recidivism?

Now if you run a flight school and are hiring CFIs, then like any other institution common sense liability rules apply.
As an ice hockey official I have to get a background check every two years because I might somehow be in a position of authority over a youth player. I haven't quite figured that one out yet, but I don't really care—it's their risk management policy, and it's fine by me. I also stay out of closed rooms with minors—that's MY risk management policy. :>

But all that aside, what exactly do you expect? He's "paid his debt to society", as the saying goes.

By the way, your avatar is for a kids show, and you seem to know a lot about pedophilia.

A little suspicious, if you ask me!

(PS. Not really.)

No point in going to jail.

Unless, of course, you're "into that" and either yours a real good cell block fighter or handy with a hair brush!
I've spent enough time on the road to have been forced into some situations where you gotta handle your business. I'm still drawing air.

Knock yourself out, bro!

I don't find any honor in physically involving myself in a situation like this. Vigilantism makes for a great Charles Bronson movie though.
