New FAA Policy on Settlement of False Statements on Medical Certificates

I figured I'd post this generally rather than in the legal or medical forum...

The 9/24/2020 Federal Register includes a new FAA policy on the settlement of violations for false statements on medical certificate applications. The FAA treats these violations very seriously, generally resulting in revocation of all airman certificates. A practical issue for pilots and others who plan to reapply for their pilot or instructor certificates is the length of time the process can take from discovery of the violation to the revocation itself. There is, in addition a general 1year wait between revocation and reapplication. The new policy is intended to give most (but not all) airmen the option to settle the violation early. The process includes notification of the availability of settlement in the initial Letter of Investigation (LOI), airman request to explore settlement within 10 days after receiving the LOI, and the airman’s acceptance of the settlement agreement within 10 days after receiving it. The Federal Register announcement is available at https://www.govinfo.gov/content/pkg/FR-2020-09-24/pdf/2020-21111.pdf.

This is for general information. Certificate action is not something any airman should face without professional advice and representation.
