Nasa form question

If you are going to get a violation for something NASA form or not (known as something that is not sole-source) then fill out the NASA form.

If you'd be disclosing something that nobody otherwise would have known about, use your own judgement.

No violation, just for future reference looks like a bad idea to submit one

For the stuff that the program covers, the FAA will never find out about it from NASA. If the FAA finds out about the infraction from another source, you may get a violation, but the NASA form from protects you from the penalty.
 
For reported criminal acts and aircraft accidents, NASA forwards the reports to the DOJ or NTSB respectively. For everything else, NASA de-identifies the reports, then releases it on their website. NASA does NOT disclose to the FAA. Unintentional violations of FAA regulations are not criminal acts (unless frequent, repeated, then they cross the line to intentional, and even then NASA doesn't send the info to the FAA, FAA finds out on its own).

Make sure you don't put anything in your "human factors" side of the report than can be traced back to you, and send it in.

The NASA form is part of a program that

(a) allows pilots, controllers, etc to anonymously report (except reports of accidents or criminal activity) events that talk about safety of flight ; and

(b) if the reporter is facing an enforcement action (based on sources other than the report), will usually allow the reporter to avoid the penalty

I have no idea how people get the idea that filling out the form is a bad thing.
 
I would say that this 'fear' of NASA forms is purely mythological. It's there to improve safety! Don't be afraid to use it for anything. Even if you SEE something that you thought was unsafe and you have an opinion on why it happened or what could have prevented it, fill one out!

The system only works with participation.

Short answer. No. File one if you believe an error has occurred on your part or anyone else's that you are working with (ie ATC problem, misunderstood clearance).

The NASA ASRS is coming close to being swamped, if not already, with data BUT it is a useful program for finding out what is going on in the overall environment.

Where is your data that says the program is close to being swamped? I'd like to read it.
