Is this legal?

Are we really arguing about this?

How about this?
Your wife happens to give you some money before your trip and you use that money toward helping her get to her meeting.
Even better. Your wife happens to deposit the amount into a joint account in your names, you use some of it to pay for the flight.

As mentioned before, the intent of the Section is to weed out people who are trying to operate for hire without the proper certifications.

Neither of us is really licensed to practice in aviation-related law, however, so we cannot legally advise you as to what is legal and what is not.

Not really an argument - I just thought it would make for interesting discussion, which it did.

I've never understood how it's perfectly legal to pay someone for just being in your company (personal assistants, male/female escorts), yet if that person is in an airplane, then it can't happen. I can understand the rule against holding out to the public, but why limit flying your family and close friends for hire? It seems you could always get away with saying you did the flight for free, and it just so happens a week later that person gave you the same amount of money as the flight costs for something unrelated. It seem like it would be impossible to prove the payment was for the flight and nothing else. On the other hand, if the pilot was holding out to the public, then it could be very easy to prove the payment was for the flight...

husband and wife doesn't haev to say anythig to FAA, let alone to court... for all they know, its your money.
